Terms & Conditions

These Terms & Conditions govern your use of https://www.aknovus.com (the "Website") and all services provided by AK Novus LLC ("we," "us," or "our"). By using our Website or purchasing any services, you agree to these Terms.

1. Services

We provide custom website design and development, web application development, content creation, analytics setup, email marketing integration, SEO, hosting, domain management, and ongoing maintenance/subscription services.

2. Ordering & Payment

• A 50% non-refundable deposit is required when requested before work begins. This deposit secures resources (VPS, domains, third-party services, etc.).
• Final payment is due in full before the project is launched or delivered.
• We accept credit card payments via Stripe.
• All subscription services are offered on monthly or annual billing cycles. Annual plans receive a two-month discount equivalent.

3. Revisions & Scope

• Each project includes up to three (3) rounds of major revisions within the original agreed scope.
• Minor tweaks and adjustments are unlimited within scope.
• Any additional work outside the original scope will be quoted and invoiced separately.

4. Project Timelines & Client Delays

Estimated timelines are provided in each package. If you delay providing required content, assets, or feedback, we will insert professional placeholder content to continue development. You will receive reminder communications until final content is supplied. Delays caused by you do not extend the original timeline or constitute breach on our part.

5. Intellectual Property & License

• Upon receipt of 100% payment, we transfer full ownership and copyright of the final deliverables to you.
• We retain a perpetual, royalty-free license to display your logo, screenshots, and the finished website in our portfolio and marketing materials.

6. Subscriptions & Cancellation

• You may cancel a subscription at any time. Access continues until the end of the current paid billing period. No partial-month or annual refunds are provided.
• Failed renewal payments trigger a 14-day grace period with reminders on day 0, 5, 10, and 13.
• Services are suspended on day 30 and the site is taken offline.
• All project data is permanently deleted after 90 days of non-payment. A final ZIP archive of your project code will be emailed before deletion.

7. Mid-Project Cancellation

If you cancel a project after work has begun, we will assess progress and invoice you for work completed. Upon payment of any outstanding balance, you will receive a ZIP file containing all code and assets created up to that point.

8. 90-Day Warranty

We will fix, at no additional charge, any legitimate bugs or defects in our work reported within 90 days of launch. This warranty does not cover issues caused by your modifications, third-party plugins, or hosting environment changes.

9. Limitation of Liability

To the maximum extent permitted by law, our total liability is limited to the total amount you paid us for the specific project or development services (excluding recurring subscription fees). We are not liable for indirect, incidental, or consequential damages.

10. Disclaimers

We do not guarantee specific search engine rankings, traffic levels, conversion rates, or 100% uptime unless explicitly covered by a separate hosting SLA.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Texas and applicable U.S. federal law. Any dispute must first be submitted to binding arbitration in Dallas County, Texas under the rules of the American Arbitration Association. You waive the right to participate in class-action lawsuits.

12. Changes to These Terms

We may update these Terms at any time. Continued use of our services after changes constitutes acceptance of the new terms.
